Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Edgible (“Edgible”, “we”, “us”) governing your use of the Edgible platform, websites, APIs, agents, command-line tools, SDKs, and related services (collectively, the “Service”). By creating an account, ticking the acceptance box at signup, or accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes it.
1. Eligibility
- You must be at least 18 years old (or the age of legal majority where you live) to use the Service.
- You may not use the Service if you are barred from doing so under the laws of any applicable jurisdiction, including export-control and sanctions laws.
2. The Service
- Edgible provides a platform for securely exposing and orchestrating services that run on your own hardware and infrastructure, including device enrolment, VPN tunnelling, traffic routing, monitoring, and related tools.
- Edgible is an orchestration and connectivity layer. We do not host, operate, control, or monitor the devices, workloads, applications, or content you run or expose through the Service.
- We may improve, modify, or discontinue features of the Service. Where a change materially reduces the core functionality of a paid plan, we will give you reasonable advance notice where practicable.
3. Your Infrastructure, Your Responsibility
Because the Service runs against infrastructure you own or control, you — not Edgible — are solely responsible for:
- The devices, servers, networks, and other hardware you enrol, including their physical and network security, operating systems, and patching.
- Every workload, application, service, and piece of content you deploy, run, or expose through the Service, including its legality, licensing, security, and the traffic it sends or receives.
- Anything made reachable over the internet through the Service. You are the operator and publisher of the services you expose, and you must have the legal right to run and expose them.
- Complying with all laws and regulations that apply to your use of the Service and to the services you expose, including data-protection, consumer, telecommunications, content, and intellectual-property laws in every jurisdiction you operate in or serve.
- Maintaining backups of your data and configurations. The Service is not a backup service.
- All activity that occurs through your devices, agents, API keys, and account credentials.
4. Accounts
- You must provide accurate and complete information when creating an account and keep it up to date.
- You are responsible for safeguarding your credentials, API keys, and agent tokens, and for all activity under your account. Notify us immediately at support@edgible.com of any unauthorized use.
- We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to, and not to permit anyone using your account or infrastructure to:
- Use the Service for any unlawful purpose, or to run, expose, store, or transmit material that is illegal, infringing, defamatory, or that violates the rights of others.
- Distribute malware, operate botnets or command-and-control infrastructure, send spam, or conduct phishing, fraud, or denial-of-service attacks.
- Probe, scan, or attack systems you are not authorized to test, or attempt to gain unauthorized access to the Service or to other users’ accounts, devices, or data.
- Interfere with or disrupt the Service, circumvent usage limits or security measures, or resell the Service without our written agreement.
- Use the Service in circumstances where its failure could lead to death, personal injury, or severe physical or environmental damage (e.g., life support, air traffic control, weapons systems). The Service is not designed or licensed for such use.
We may investigate suspected violations and may remove routing for, suspend, or disable any device, application, or account we reasonably believe violates this section, with or without notice.
6. Plans, Fees, and Taxes
- Edgible offers a free Starter plan and paid plans; current plans and pricing are published on our pricing page.
- Paid plans are billed as described at purchase. You are responsible for applicable taxes, which we may collect where required.
- We will give you advance notice before any change to the pricing of your plan takes effect; changes apply from your next billing period after the notice.
- Except where required by law, fees are non-refundable.
7. Your Content
- You retain all rights to the data, configurations, applications, and content you provide to or run through the Service (“Your Content”).
- You grant Edgible a limited, non-exclusive, worldwide license to host, process, transmit, and display Your Content solely as necessary to provide, secure, and support the Service.
- You are solely responsible for Your Content. We have no obligation to monitor it, but we may remove or disable access to content that we reasonably believe violates these Terms or the law.
8. Edgible’s Intellectual Property
- The Service, including our software, agents, documentation, and branding, is owned by Edgible or its licensors and is protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Service, or reverse-engineer it except where the law permits despite this restriction.
- Open-source components included in the Service are licensed under their own terms, which govern to the extent they conflict with these Terms.
- If you give us feedback or suggestions, we may use them without restriction or obligation to you.
9. Third-Party Services
The Service interoperates with third-party software, networks, and services (for example, your DNS provider, container registries, or cloud services). Your use of those is governed by their own terms, and Edgible is not responsible for them.
10. Privacy and Data Protection
- Our Privacy Policy explains what personal data we collect and how we handle it, including in accordance with applicable data-protection laws such as the GDPR, UK GDPR, and the Australian Privacy Act. By using the Service you acknowledge that we process personal data as described there.
- To the extent you use the Service to process personal data of others (for example, users of services you expose), you are the controller of that data and are responsible for having a lawful basis to process it and for meeting your own obligations under applicable data-protection law.
11. Availability
- We aim for high availability but the Service is provided without any uptime commitment or service-level agreement unless we have agreed one with you in writing.
- The Service may be interrupted by maintenance, updates, failures of third-party networks, or events outside our control.
12. Disclaimer of Warranties
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE WILL PREVENT UNAUTHORIZED ACCESS TO YOUR DEVICES OR DATA. USING THE SERVICE TO EXPOSE SERVICES TO THE INTERNET CARRIES INHERENT RISK THAT YOU ACCEPT.
- Section 14 (Consumer Rights) applies to everything in this section.
13. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDGIBLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- IN PARTICULAR, AND WITHOUT LIMITING THE FOREGOING, EDGIBLE IS NOT LIABLE FOR: (a) THE DEVICES, WORKLOADS, APPLICATIONS, OR CONTENT YOU RUN OR EXPOSE THROUGH THE SERVICE, OR ANY CLAIM ARISING FROM THEM; (b) UNAUTHORIZED ACCESS TO, OR LOSS OF, YOUR DEVICES, DATA, OR SERVICES; (c) ACTS OR OMISSIONS OF THIRD PARTIES OR THIRD-PARTY NETWORKS; OR (d) YOUR FAILURE TO SECURE, PATCH, OR BACK UP YOUR OWN INFRASTRUCTURE.
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDGIBLE’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (a) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (b) AUD $100.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence.
14. Consumer Rights (Non-Excludable Guarantees)
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies under the Australian Consumer Law, the consumer laws of the European Union or United Kingdom, or any other applicable law that cannot lawfully be excluded.
- Where such a law permits us to limit our liability for breach of a non-excludable guarantee, our liability is limited, at our option, to resupplying the affected services or paying the cost of having them resupplied.
- If you use the Service as a consumer, you retain the benefit of any mandatory consumer-protection laws of the country where you live, and nothing in these Terms deprives you of them.
15. Indemnification
To the maximum extent permitted by law, you will indemnify, defend, and hold harmless Edgible and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content or the devices, workloads, or services you run or expose through the Service; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party. This section does not apply to consumers to the extent prohibited by the mandatory laws of their country of residence. We may assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate with us.
16. Export Controls and Sanctions
The Service, including its VPN and encryption technology, may be subject to export-control and sanctions laws. You may not use or access the Service in embargoed countries or regions, or if you are on any restricted-party list, and you may not use the Service in violation of any export-control or sanctions law.
17. Suspension and Termination
- You may stop using the Service and close your account at any time from the console or by contacting support@edgible.com.
- We may suspend or terminate your access immediately if you materially breach these Terms, if required by law, or to address a security risk, fraud, or abuse.
- We may otherwise terminate the Service or your account for convenience with at least 30 days’ notice; if you have prepaid for a period beyond termination, we will refund the unused portion.
- On termination, your right to use the Service ceases. Provisions that by their nature should survive (including Sections 7, 8, 12–16, 18, and 19) survive.
18. Governing Law and Disputes
- These Terms are governed by the laws of Australia, and disputes are subject to the exclusive jurisdiction of the courts of Australia — except that if you are a consumer, you retain any right you have to bring proceedings in, and under the mandatory laws of, the country where you live.
- If any provision of these Terms is unenforceable, it will be enforced to the maximum extent permissible and the remainder will remain in full force.
19. General
- Changes to these Terms. We may update these Terms from time to time. For material changes we will give notice (for example, by email or in the console) at least 30 days before they take effect where practicable. Your continued use of the Service after the effective date constitutes acceptance; if you do not agree, you must stop using the Service before the changes take effect.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement; no waiver. These Terms, together with the Privacy Policy and any plan-specific terms, are the entire agreement between you and Edgible regarding the Service. A failure to enforce a provision is not a waiver of it.
